The press center of the Ministry of Interior announced that from June 4 to June 10, in Bulgaria and in all countries, members of the European Union, a police operation is being conducted to establish the use of alcohol, drugs or their analogues by drivers. During the inspections, the police teams will also monitor the existence of a valid compulsory Civil Liability Insurance.
According to the Road Traffic Act:
- With the latest editions from 2017 of the Road Traffic Act, the provision of Art. 5, para. 1 is categorical that "the driver of a road vehicle is prohibited to drive a vehicle with a blood alcohol concentration above 0.5 per thousand and / or after the use of narcotic substances or their analogues";
- It is also prohibited for the driver, owner or authorized user of the vehicle to provide his driving to a driver who has a blood alcohol concentration above 0.5 per thousand and / or has used drugs or their analogues - Art. 102, para. 1, item 1;
- With regard to the coercive administrative measures art. 171, vol. 1, p. "b" stipulates that a driver who drives a motor vehicle with a blood alcohol concentration above 0.5 per thousand is temporarily deprived of the driving license;
- In v.2, b. "and" of the same art. 171 of the LPA provides for a compulsory administrative measure of temporary suspension of traffic of an owner who allows or provides driving to another driver who has a blood alcohol concentration above 0.5 per thousand and / or has used drugs or their analogues;
- An owner of a car who is found by traffic police to drive after using alcohol or drugs, but refuses to be tested, risks termination of registration of the vehicle for a period of 6 months to one year.
The penalties for the violations are regulated in art. 174 of the Law on Public Procurement, according to which:
- Shall be punishable by deprivation of the right to drive a motor vehicle, tram or self-propelled machine that drives a motor vehicle, tram or self-propelled machine with a blood alcohol concentration established by medical and chemical examination and / or by a technical device determining blood alcohol concentration by its measurement in exhaled air:
- over 0.5 per thousand to 0.8 per thousand inclusive - for a period of 6 months and a fine of BGN 500;
- over 0.8 per thousand to 1.2 per thousand inclusive - for a period of 12 months and a fine of BGN 1,000.
- When the violation described above (under Art. 174, para. 1) is committed repeatedly, the punishment is deprivation of the right to drive a motor vehicle, tram or self-propelled machine for a period of one to three years and a fine of BGN 1,000 to 2,000;
- Driver of a motor vehicle, tram or self-propelled machine who refuses a test with a technical device for determining the use of alcohol in the blood and / or a test for detecting the use of narcotic substances or their analogues or fails to comply with the prescription test or medical examination and taking biological samples for chemical laboratory testing to determine the concentration of alcohol in his blood, and / or chemical-toxicological laboratory testing to determine the use of narcotic substances or their analogues, shall be punished by deprivation of the right to drive a motor vehicle, tram or self-propelled machine for a period of two years and a fine of BGN 2,000;
- According to the Penal Code, driving a vehicle with a blood alcohol concentration above 1.2 per thousand is punishable by imprisonment of 1 to 3 years and a fine of BGN 200 to 1,000;
- When driving a motor vehicle after using narcotic substances or their analogues, the punishment is imprisonment of 1 to 3 years and a fine of BGN 500 to 1,500.
